By accessing or using the MyoFactor mobile application and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

MyoFactor provides a mobile application that offers personalized strength training programs, workout tracking, and automated progressive overload features. The Service is designed to assist users in their fitness journey but is not a substitute for professional medical advice.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Health and Safety Disclaimer

IMPORTANT: The Service provides fitness information and workout programs for informational purposes only. You acknowledge that:

  • Exercise involves inherent risks of physical injury
  • You should consult with a healthcare provider before beginning any exercise program
  • You are responsible for ensuring exercises are performed correctly and safely
  • We are not liable for any injuries or health issues resulting from use of the Service
  • You use the Service at your own risk

5. Subscription and Payment

Certain features of the Service may require a paid subscription. By subscribing, you agree to:

  • Pay all fees associated with your subscription
  • Automatic renewal unless cancelled before the renewal date
  • Price changes with 30 days' notice
  • No refunds except as required by law or at our discretion

6. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or servers
  • Transmit any viruses, malware, or harmful code

The Service and its original content, features, and functionality are owned by MyoFactor and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYOFACTOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Indemnification

You agree to defend, indemnify, and hold harmless MyoFactor and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service or violation of these Terms.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MyoFactor operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
